Crossing Documents Clearing Services LLC (‘’COMPANY”) maintains the theimmigrationoffice.com Website (“Site”). The following are the terms of use that govern use of the Site (“Terms of Use”). By using the Site you expressly agree to be bound by these Terms of Use and the theimmigrationoffice.com privacy policy and to follow these Terms of Use and all applicable laws and regulations governing use of the Site. THE IMMIGRATION OFFICE COMPANY reserves the right to change these Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms of Use. If you violate these Terms of Use, THE IMMIGRATION OFFICE COMPANY may terminate your use of the Site, bar you from future use of the Site, and/or take appropriate legal action against you.

SERVICES TO BE RENDERED

  1. Initial Consultation to evaluate Client’s particulars selection criteria pursuant to Visa Category.
  2. Provide detailed consultation using dedicated Case Management System and up to date requirements of the authorized assessing bodies.
  3. Creation of application profile for the Client and Client’s dependents
  4. Complete preparation of required file for the purpose of application for Visa Category.
  5. Represent the Client with all registered authorities in order to provide all information and documents required for the application.
  6. Upon receipt of Invitation to Apply, submission of final stage application under registered agent.
  7. The Counseling and Preparation of the Client for any personal interview required.
  8. All other matters The Immigration Office may consider necessary in an effort to ensure that the Client’s application is properly processed.
  9. Lodge online application to relevant Assessment body. It is the Client’s responsibility to present accurate, complete information and relevant education documents and any other supporting document/information required and/or requested through a registered agent.

The Client further acknowledges that the time required to process an immigration application depends on multiple factors, which are beyond The Immigration Office control. The Client acknowledges that no warranty is given as to the length of time required to process the application or the visa issuance. The Immigration Office as a consultancy firm, undertakes to give consultancy to the Client and coordinate with the Client and the relevant Government offices/s but cannot guarantee visa issuance as that purely is the discretion of the relevant Government office.

SERVICE DELIVERY

The Service to be delivered refers to a consultancy service delivered at the time the Client is assigned to a Case Manager and his application is launched by the registered agent. The duration of the service is out of the consultant control and depends solely on the respected Government authorized to issue an answer to the visa application.

The company’s consultancy service is delivered at the time of retaining the service, evaluation of the case and submission of the application, based on the stages mentioned within the Retainership Agreement.

SERVICE PRICING

The basic consultancy fee for the company’s consultancy services is AED 12,000 as a onetime payment. Based on a case to case evaluation the consultancy fee is subject to changes, depending on client’s situation and further evaluation.

THE IMMIGRATION OFFICE COMPANY makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

  1. APPLICABLE LAW & DISPUTE

In the event of a dispute, both parties mutually agree to seek out mediation to resolve the rising issue at the cost of the party who initiated the complaint. Both parties must agree on a mutual mediator and will put their best effort forward in order to resolve the issue to a mutually acceptable benefit.

The representative agrees to respond to written complaint within maximum of 30 days from receiving the complaint.

In term of 30 days the written complaint will be handled with all effort to resolve the complaint.

If mediation is unsuccessful the dispute will then proceed to a group of Arbitrators which are registered as such, retained by the person bringing the action. Any dispute arising out of or in connection with this agreement, except for claims which have been waived by the making or acceptance of final payment, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the DIFC-LCIA Arbitration Center, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be Dubai, UAE. The language to be used in the arbitration shall be English. The governing law of the contract shall be the substantive law of the UAE.

Notice of a demand for arbitration shall be filed within a reasonable time after the claim, disputes or other matter in question has arisen, and in no event shall such demand be entertained after the date when legal proceedings based on such claims, disputes or other matter in question would be barred by the applicable statute of limitations. Following demand for arbitration and during any arbitration proceedings, both parties shall continue to fulfill their obligations under the Agreement unless mutually agreed upon otherwise.

In the event it becomes necessary for any party to the Agreement to enforce any of its rights arising hereunder, the successful party to any such dispute shall be entitled to its costs including an award of a reasonable attorney’s fee.

  1. MULTI-CURRENCY PRICED TRANSACTION, the displayed price and currency selected by you, will be the same price and currency charged to the Card and printed on the Transaction Receipt.
  2. PURCHASES. THE IMMIGRATION OFFICE COMPANY accepts payment by Visa or MasterCard debit and credit cards in AED for its products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of COMPANY. All refunds will be made onto the original mode of payment.
  3. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES. THE IMMIGRATION OFFICE COMPANY will not trade with or provide any services to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country specific
  4. REPRESENTATIONS BY YOU.

You must obtain COMPANY’s prior written consent to make commercial offers of any kind on the Site, whether by advertising, solicitations, links, or any other form of communication. THE IMMIGRATION OFFICE COMPANY will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site.

  2. SELECTION, CANCELATION, REJECTION AND REFUND POLICY  

16.1. Client is eligible for cancelation only before being assigned to a Case Manager. After the client has been assigned to a Case Manager, the client benefits from the Consultancy service so the contract cannot be subject to cancelation.

16.2. Services fees paid to The Immigration Office except down payment can be refunded after second submission in the event of Client being not qualified for reasons other than: Medical, Security, Misrepresentation, Insufficient information, Insufficient funds, point lost on language or Misleading information, Point lost on education because of non-accredited, unrecognized or false credential, Points lost on work experience where in the case officer was not satisfied with the evidence furnished by the applicant, non-submission of complete/required documents from clients side within stipulated time changes introduced by the relevant Government office which may retroactively affect the client’s case, non-cooperation from client’s or client’s dependents side and any other violation of contractual clause. If the reason of rejection is any of the above, client will be liable to pay balance fee to The Immigration Office with immediate effect. In case the Client is entitled to a refund, the refund application will be processed within 30 days.

In case the applicant is not selected for the final stage, The Immigration Office takes the responsibility to provide:

16.2. Free 2nd submission if in 1 years’ time after registering.

16.3. Refund in case after 2nd submission the Client’s application is not selected for final stage for any other reason than specified in 16.1.

Note: Credit Card and/or Bank Charges:

The Client acknowledges that in the event refund request is found eligible as per the contract, and approved; the refund will be processed in 10 working days after retaining due retainer fees as per the contract, credit card/Easy Payment Plan (EPP) charges incurred during the process anytime and not charged to the Client earlier will also be deducted from the amount approved for refund and balance amount will be refunded to the Client.

The On-line Materials are and will remain the exclusive property of THE IMMIGRATION OFFICE COMPANY. All rights, titles and interests in and to the On-line Materials will be and remain vested solely in THE IMMIGRATION OFFICE COMPANY. Under no circumstances will you have any right, directly or indirectly, to own, use, copy, loan, sell, rent, lease, license, sublicense, redistribute, assign or otherwise convey the On- line Materials, or any rights thereto, except as expressly and specifically provided in the Terms of Use. Nothing in these Terms of Use will convey to you any right, title or interest, except that of a license with the express rights and subject to all limitations herein. Nothing in these Terms of Use grants you the right, directly or indirectly, to use the On-line Materials to create a product for resale or to use the On-line Materials in any way that competes with THE IMMIGRATION OFFICE COMPANY.

You acknowledge and agree that THE IMMIGRATION OFFICE COMPANY will own all rights, titles and interests in and to any copy, translation, modification, adaptation, derivative work or improvement of the On- line Materials made by or for you. At COMPANY’s request, you must execute, or obtain the execution of, any instrument that may be necessary to assign these rights, titles or interests to THE IMMIGRATION OFFICE COMPANY or perfect these rights, titles or interests in COMPANY’s name. DISCLAIMER OF WARRANTY, LIMITATION OF DAMAGES. You agree that monetary damages may not provide a sufficient remedy to THE IMMIGRATION OFFICE COMPANY for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. INDEMNITY. You agree to indemnify and hold COMPANY, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or relating to your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site, or your breach of the Terms of Use.

LICENCE GRANTED TO YOU. By providing materials to COMPANY, including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted THE IMMIGRATION OFFICE COMPANY an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. ADVERTISING. The Site may contain advertisements and/or sponsorships.
